1. Agreement to Terms
By accessing or using Heritage Embassy ("the Platform", "we", "us", or "our"), you agree to be bound by
these Terms and Conditions. If you disagree with any part of these terms, you may not access the
Platform.
2. Definitions
- "Guest" refers to users who book experiences through the Platform
- "Host" refers to users who offer cultural and heritage experiences through the
Platform
- "Experience" refers to cultural, heritage, or educational activities offered by
Hosts
- "Booking" refers to a confirmed reservation for an Experience
- "User" refers to any person using the Platform, whether as a Guest or Host
3. Eligibility
You must be at least 18 years of age to use this Platform. By using the Platform, you represent and
warrant that you meet this age requirement and have the legal capacity to enter into these Terms and
Conditions.
4. Account Registration
4.1 Account Creation
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You agree to notify us immediately of any unauthorized access to your account
- You are responsible for all activities that occur under your account
4.2 Account Termination
We reserve the right to suspend or terminate your account at any time for:
- Violation of these Terms and Conditions
- Fraudulent or illegal activities
- Providing false or misleading information
- Complaints from other users
5. For Guests
5.1 Booking Process
- All bookings are subject to Host availability and confirmation
- Booking confirmations will be sent via email
- You agree to arrive on time and respect the Host's property and rules
- Payment must be completed at the time of booking
5.2 Cancellation Policy
- Cancellations made more than 48 hours before the Experience: Full refund
- Cancellations made 24-48 hours before the Experience: 50% refund
- Cancellations made less than 24 hours before the Experience: No refund
- Hosts reserve the right to set their own cancellation policies
5.3 Guest Conduct
Guests agree to:
- Treat Hosts and their property with respect
- Follow all safety guidelines provided by the Host
- Not engage in illegal activities during Experiences
- Provide honest reviews based on their actual experience
6. For Hosts
6.1 Host Responsibilities
Hosts agree to:
- Provide accurate descriptions of their Experiences
- Maintain appropriate licenses, permits, and insurance
- Deliver Experiences as described in their listings
- Maintain a safe environment for Guests
- Respond to booking requests in a timely manner
- Honor confirmed bookings unless extraordinary circumstances arise
6.2 Host Profile
- All information in your Host profile must be accurate and current
- You must update your availability calendar regularly
- You may not discriminate against Guests based on race, religion, nationality, disability, gender,
sexual orientation, or age
6.3 Pricing and Payments
- Hosts set their own pricing for Experiences
- Platform fees will be deducted from Host earnings as specified
- Payments will be processed according to our payment schedule
- Hosts are responsible for reporting income and paying applicable taxes
6.4 Host Cancellations
- Hosts should avoid cancelling confirmed bookings
- Frequent cancellations may result in account penalties or suspension
- In case of emergency cancellations, Hosts must notify Guests immediately
7. Booking Modifications and Cancellations
7.1 Modifications
Either party may request modifications to a booking. Both parties must agree to any changes.
7.2 Platform-Initiated Cancellations
We reserve the right to cancel bookings if:
- We suspect fraudulent activity
- The Experience violates our policies
- There are safety concerns
8. Payments and Fees
8.1 Payment Processing
- All payments are processed securely through our payment partners
- Guests authorize us to charge their payment method for bookings
- Prices are displayed in the currency specified and include applicable taxes unless stated otherwise
8.2 Platform Fees
- We charge a service fee for each booking
- Host service fees are deducted from Host earnings
- Guest service fees are added to the booking total
- Fee structures are available on our website and may change with notice
8.3 Refunds
- Refunds are processed according to the cancellation policy
- Refunds may take 5-10 business days to appear in your account
- Platform fees are non-refundable except in cases of Host cancellation
9. Reviews and Ratings
9.1 Review Policy
- Both Guests and Hosts may leave reviews after an Experience
- Reviews must be honest, accurate, and based on actual experiences
- Reviews containing profanity, discrimination, or personal attacks will be removed
- We reserve the right to remove reviews that violate our policies
9.2 Review Disputes
If you believe a review is inaccurate or violates our policies, you may contact us for review.
10. Prohibited Activities
You may not:
- Use the Platform for any illegal purpose
- Harass, abuse, or harm other users
- Post false, misleading, or defamatory content
- Attempt to circumvent the Platform's payment system
- Scrape or copy content from the Platform without permission
- Use automated systems to access the Platform
- Impersonate another person or entity
- Violate any applicable laws or regulations
11. Intellectual Property
11.1 Platform Content
All content on the Platform, including text, graphics, logos, and software, is owned by Heritage Embassy
or its licensors and protected by copyright and trademark laws.
11.2 User Content
- You retain ownership of content you post on the Platform
- By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display,
and distribute your content
- You represent that you have the right to post all content you submit
- We may remove any content that violates these terms
12. Privacy and Data Protection
Your use of the Platform is also governed by our Privacy Policy. We collect, use, and protect your
personal information as described in our Privacy Policy.
13. Liability and Disclaimers
13.1 Platform Role
Heritage Embassy acts as a marketplace connecting Guests and Hosts. We do not:
- Organize, conduct, or control Experiences
- Employ or supervise Hosts
- Guarantee the quality, safety, or legality of Experiences
- Verify the accuracy of Host listings or Guest information
13.2 Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
OR NON-INFRINGEMENT.
13.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HERITAGE EMBASSY SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or goodwill
- Personal injury or property damage arising from your use of the Platform
- Actions or omissions of Hosts or Guests
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
13.4 Indemnification
You agree to indemnify and hold Heritage Embassy harmless from any claims, damages, losses, or expenses
arising from:
- Your use of the Platform
- Your violation of these Terms and Conditions
- Your violation of any rights of another person or entity
14. Insurance
14.1 Host Insurance
Hosts are strongly encouraged to maintain appropriate insurance coverage for their Experiences, including
liability insurance.
14.2 Platform Insurance
While we may provide certain insurance coverage, this does not replace the need for personal insurance.
Coverage details and limitations are available upon request.
15. Dispute Resolution
15.1 Disputes Between Users
We encourage users to resolve disputes directly. If needed, we may provide mediation assistance.
15.2 Disputes with Heritage Embassy
For disputes with the Platform:
- First, contact our customer support team
- If unresolved, disputes will be governed by arbitration or applicable law as specified below
15.3 Governing Law
These Terms and Conditions are governed by the laws of [Your Jurisdiction], without regard to conflict of
law principles.
15.4 Arbitration
Any disputes arising from these terms shall be resolved through binding arbitration, except where
prohibited by law. You waive your right to participate in class action lawsuits.
16. Communication
16.1 Email Communication
By using the Platform, you consent to receive emails from us regarding:
- Booking confirmations and updates
- Account notifications
- Marketing communications (you may opt out)
- Important service announcements
16.2 Platform Messages
You agree to communicate with other users through the Platform's messaging system for booking-related
matters.
17. Modifications to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective upon
posting to the Platform. Your continued use of the Platform after changes constitutes acceptance of the
modified terms.
18. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining
provisions shall remain in full force and effect.
19. Entire Agreement
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you
and Heritage Embassy regarding the use of the Platform.
20. Force Majeure
We shall not be liable for any failure to perform our obligations due to circumstances beyond our
reasonable control, including natural disasters, war, terrorism, pandemics, or government actions.
21. Survival
Provisions regarding liability, indemnification, intellectual property, and dispute resolution shall
survive termination of your account or these Terms and Conditions.
